1. Introduction and Acceptance

These Terms and Conditions govern the use of the Foodoso.com website (hereinafter "Site" or "Service"), operated by Associazione Papalugia, with registered office at Via Giacomo Peroni 106, 00131 Rome, Italy (hereinafter "Association" or "We").

By accessing and using the Site, the user declares to have read, understood, and fully accepted these Terms. If you disagree with any provision, please refrain from using the Service.

2. Description of the Service

Foodoso is a platform dedicated to discovering and promoting traditional Italian dishes. The Service offers:

  • Restaurant rankings based on the quality of specific traditional dishes
  • Reviews and ratings prepared by a network of anonymous tasters ("Palati Anonimi")
  • Information about restaurants, dishes, and Italian culinary traditions
  • The possibility for users to suggest restaurants worthy of evaluation

3. Registration and User Account

To access certain features of the Site, account creation may be required. The user agrees to:

  • Provide truthful, accurate, and complete information
  • Keep login credentials confidential
  • Promptly notify any unauthorized use of their account
  • Be solely responsible for all activities carried out through their account

The Association reserves the right to suspend or delete accounts that violate these Terms.

4. User-Generated Content

Users may contribute to the Service through restaurant suggestions and other forms of participation. By publishing content, the user:

  • Guarantees being the author or having the necessary rights for publication
  • Grants the Association a non-exclusive, free, and worldwide license to use, modify, and publish such content
  • Assumes full responsibility for the published content

The Association reserves the right to remove any content deemed inappropriate, offensive, defamatory, or in violation of these Terms.

5. The Anonymous Tasters (Palati Anonimi)

The "Palati Anonimi" are tasters selected by the Association who conduct anonymous visits to restaurants. Their evaluations:

  • Are expressions of personal opinions based on criteria defined by the Association
  • Do not constitute absolute judgments on the overall quality of a restaurant
  • May vary over time based on subsequent verifications

6. Intellectual Property

All content on the Site, including texts, graphics, logos, images, ranking algorithms, and software, are the property of the Association or their respective owners and are protected by copyright and intellectual property laws.

Copying, modifying, distributing, or using the Site's content without prior written authorization is prohibited.

7. Prohibited Conduct

When using the Service, the following is expressly prohibited:

  • Publishing false, misleading, or defamatory content
  • Attempting to manipulate rankings or the evaluation system
  • Using the Service for unauthorized commercial purposes
  • Violating third-party privacy or collecting personal data without consent
  • Interfering with the Site's operation or attempting unauthorized access
  • Using bots, spiders, or other automated systems

8. Disclaimer of Warranties and Limitation of Liability

The Service is provided "as is" without warranties of any kind. The Association does not guarantee:

  • The accuracy, completeness, or timeliness of published information
  • Continuous and uninterrupted availability of the Service
  • The absence of errors or malfunctions

The Association shall not be liable for direct, indirect, incidental, or consequential damages arising from the use or inability to use the Service, to the extent permitted by applicable law.

The ratings and rankings expressed on the Site represent opinions and should not be considered as absolute truths or guarantees about the quality of reviewed restaurants.

9. Links to Third-Party Sites

The Site may contain links to third-party websites. The Association has no control over such sites and disclaims any responsibility for their content, privacy policies, or practices.

10. Modifications to Terms

The Association reserves the right to modify these Terms at any time. Changes will be published on this page with an indication of the update date. Continued use of the Service after publication of changes constitutes acceptance thereof.

11. Privacy

The processing of personal data is governed by our Privacy Policy, available on the Site, which forms an integral part of these Terms.

12. Termination and Suspension

The Association may suspend or terminate access to the Service in case of violation of these Terms or for any other legitimate reason, without notice and without any obligation to refund.

13. Governing Law and Jurisdiction

These Terms are governed by Italian law. For any dispute arising from the interpretation or execution of these Terms, the Court of Rome shall have exclusive jurisdiction, unless otherwise provided by mandatory law.

14. Final Provisions

Should any provision of these Terms prove invalid or unenforceable, the remaining provisions shall remain fully valid and effective.

Failure by the Association to exercise a right shall not constitute a waiver thereof.
